1. THE CONTRACT BETWEEN US
When you make a reservation with Baker Travel SL (Simply Golf Travel) you enter into a contract with Baker Travel SL, company number 1/2013/19.886,0 and CIF Number of B30880322 with the registered address of Calle Mariano Rodrigues de Teresa, Murcia, Spain. Baker Travel SL is a fully licenced and regulated Travel Agent based in Murcia Spain.
The contract between us is subject to the following terms and conditions.
2. ACCURACY AND INFORMATION
Baker Travel SL has been very careful to ensure that the published information and prices are accurate, should we identify any errors or omissions we will rectify them as soon as possible. However other than the Booking Conditions we make no guarantee that the information is accurate and up to date and we accept no liability for any loss or damage caused by inaccurate information to the fullest extent permitted by law. If you find anything on our website that you believe to be inaccurate please let us know and we will correct it, where we agree, as soon as we can.
3. OUR DESCRIPTIONS
The descriptions of the hotels and golf courses and other aspects of the holidays are based on opinions gained on site visits and on the opinions of hotels themselves. We are not always able to exercise control over all the components of the holiday arrangements and it is possible that an advertised amenity be withdrawn or changed due to various reasons such as water conservation, renovation work, etc. We will advise you if we become aware of a major change but we cannot accept liability for loss, damage or inconvenience in such circumstances.
4. HOLIDAY TYPES
We deal in two different holiday types through our Simply Golf Travel Website.
Golf Resort – This is where you book accommodation that has its own golf course and you only book golf through us for the course that is owned/managed by the accommodation providers. This type of holiday is organised by us as principal and as this does not constitute a package holiday under The Package Travel, Package Holidays and Package Tours Regulations 1992, we are not required to provide you with financial protection in the event of our insolvency.
Golf Tour – This is where we put together a pre-arranged combination of services for you such as accommodation, golf, car hire, and transport from several suppliers. We put the package together at an all-inclusive price. These Tour bookings are protected in the event of our insolvency by our AON Travel Agent Insurance in Spain.
Extras – We provide links from our website to other services that we believe may be of interest to you for example Travel Insurance, Club Hire etc. Any bookings you make with these providers are made directly with the providers via their websites. They do not form part of your booking with us and are governed by the terms and conditions of the third party provider which are on their website or are available from the provider on request. We do not have any liability in relation to any services that you book with these third party providers.
5. OUR PRICES
We always work hard to get you the best available price for your holiday and we do our upmost to ensure that our prices are correct. However we know that on occasion’s errors will be made and we reserve the right to change the price of any holiday on our website at any time up to you receiving the confirmation and the deposit having been paid. After your booking has been confirmed and we have received your deposit we may still vary the price of your break solely to allow for variations in: (1) transportation costs (2) taxes (including VAT) (3) the exchange rate applied to your break. No price variation will be made less than 30 days before the start of your break and we will absorb part of any increase equivalent to 2% of the original cost of your break.
All prices quoted by Baker Travel SL on our website (www.simplygolftravel.com) are per person and based on twin/double occupancy unless otherwise stated. Single rooms are available at many hotels however they often carry a supplement.
6. SPECIAL REQUESTS AND MEDICAL PROBLEMS
If you have any special requests, you must advise us at the time of booking. Although we will endeavour to meet any such requests we regret we cannot guarantee to do so.
7. BOOKING CONFIRMATION
On receipt of your deposit payment we will email confirmation of your booking with Baker Travel SL. The confirmation will clearly state the balance to be paid and the date by which it is due.
Please check the confirmation carefully to make sure that all your booking details are all correct. Contact us if your confirmation appears to be incorrect or incomplete and we will endeavour to make the necessary changes. Baker Travel SL. reserves the right to make changes to and correct errors after bookings have been confirmed.
A non-refundable deposit must be paid once we confirm your reservation and you are happy with the arrangements that have been made you your holiday.
Europe & the Rest of the World Golf Holidays: The minimum deposit is 15% of the total holiday value or £50 per person whichever is the greater. The balance of your booking must be paid no later than 6 weeks before your scheduled arrival at your destination.
We may also be required to ask for additional deposit amount for certain bookings where we need to pre-pay an additional sum to our suppliers to secure your booking.
Reservations made less than 6 weeks before your arrival date must be paid in full on confirmation of the reservation.
We may also request full payment earlier than 6 weeks prior to your arrival at your destination where our contracts with our suppliers demand.
If the balance is not paid by the due date, we reserve the right to cancel your booking and retain your deposit.
If your booking is for more than one person, the lead name will be responsible for the entire booking. As the lead name you guarantee that you have the authority to accept and do accept on behalf of your party the terms of our booking conditions. The lead name will be responsible for making all payments due to us in accordance with our contract. The lead name is also responsible for keeping all members of his/her party informed about all of the booking details and informing us in writing of any amendments to or cancellations of the booking.
8.1 Exchange Rates (Price Guarantee)
In order to protect our customers and our business we forward buy currency at the best rates available at the time that our customers make a reservation. This means that should the exchange rate drop to a rate less than the rate that we used in your quotation we will not increase the price of your holiday. This also means that should the exchange rate increase we cannot reduce the price of your holiday because we have forward bought currency at the rate when you made the reservation.
9. ACCEPTED FORMS OF PAYMENT
Baker Travel SL. accepts the following forms of payment:
Credit Cards – Visa, MasterCard, Maestro & Switch. Please note that we are one of the very few companies that do not charge credit or debit card transaction fees.
Bank Transfers. If you prefer to pay by Bank Transfer we will email you our bank account details.
If you have made an over payment on your booking and wish for a refund, a handling charge of £2 per person will apply. This is necessary due to the processing charges incurred. We will be happy to waiver this fee should you choose to use the over payment against the payment of another golf holiday with Baker Travel SL. in the future.
Payment Security & Authorisation
MasterCard Secure Code verification enhances the protection of your credit card account against unauthorised use provided you have registered and created your own private password with your card issuer. You will be prompted to give your password each time you make a payment.
We do not store any credit card details on our servers, from the point where you are requested to enter your card details you will be in the banks secure servers. This gives you the most secure payment method available online.
By entering your payment details, you confirm that the credit or debit card that is being used is yours or that you have been authorised by the owner of the credit or debit card to use it. All credit and debit card holders are subject to validation checks and authorisation by the card issuer. If your card issuer refuses to authorise payment, we will not be able to process your booking.
10. YOUR FINANCIAL PROTECTION
Baker Travel SL is a fully licensed Travel Agent in Murcia, Spain and has full financial protection for our customers through AON Insurance which one on of the largest and most respected insurance companies in the world.
How Does This Work? – In the event that our company or any of our suppliers that we have paid your money to goes into liquidation you can claim the full amount through our AON Insurance policy.
11. INTERNATIONAL ASSOCIATION OF GOLF TOUR OPERATORS (IAGTO)
Baker Travel SL. are members of the ‘International Association of Golf Tour Operators’ whose aim is to increase standards and professionalism within the industry. For more information visit www.iagto.com.
12. CANCELLATION / AMENDMENTS
It is possible for you to amend or cancel your holiday at any time provided that the person who originally booked the holiday sends us written notice by letter or email. If a few cases our suppliers offer deals that do not allow cancellation of amendments, we will inform you if this is the case when making the reservation.
When amending a booking it is possible that Baker Travel SL. may incur costs associated with the amendment, therefore we would need to apply these charges to you. Your first amendment will be free and any further amendments made after this, or after your balance has been paid, will be subject to a £10.00 administration fee. Any amendments will be subject to availability and any price increase.
Cancellations after the deposit has been paid to Baker Travel SL. will result in loss of all deposit monies paid. Cancellations made after final balance has been paid to Baker Travel SL. will result in loss of all deposit monies paid and loss as per the schedule shown below.

It is possible that you could recover any loss through your travel insurance and we suggest that you check the details of your travel insurance to understand the implications of cancellation.
13. TRAVEL INSURANCE
We cannot stress enough the importance of having adequate travel insurance which should commence from the date that you confirm your holiday arrangements with us.
If you decide not to purchase this insurance, or it is unavailable, you must ensure that any alternative policy you purchase covers as a minimum the cost of cancellation by you, or the full costs that could be incurred in the event of you suffering an accident or illness, including repatriation
It is your responsibility to ensure that the insurance cover you purchase is adequate for your particular needs. You should also ensure that your golf equipment is covered in the policy. Some insurance companies may consider the game of golf as a dangerous sport and you should mention your participation when obtaining a quotation.
Please read your policy details carefully and take them with you on your holiday. We do not accept any liability for any possible loss that you suffer as a result of your failure to take out an adequate insurance policy.
14. PASSPORTS, VISAS AND HEALTH REQUIREMENTS
A passport is necessary to travel to all countries. The majority of European countries enjoy the same level of medical service as we do in Great Britain however Baker Travel SL. recommends all clients INSURE THEMSELVES. If you are visiting EU community countries or Switzerland you may obtain a European Health Insurance Card (EHIC) which has replaced the E111. This card gives you access to state funded health care in these countries at a reduced rate or free of charge. You can obtain your EHIC though the NHS website. Certain countries require a pre-arranged entry visa and certain passport validity conditions; Baker Travel SL. accepts no responsibility for these requirements, and advises all travellers to ensure that the requisite documents are in place prior to travel. 15. DRESS CODE
It is your responsibility to review the dress code required by your accommodation and the golf courses that you are playing. We cannot accept any responsibility in any ruling by the hotel/golf course if you or any of your group is unable to play due to inappropriate dress. Please check before you travel that your group is aware of appropriate golfing dress codes.
16. STANDARD OF PLAY / GOLF ETIQUETTE
Knowledge of golf etiquette and the rules of golf are expected by all members of your group. Some golf courses have maximum handicap limits and will request to see handicap certificates before accepting visitors, which we will try to advise you of at the time of booking.
You should arrive at the Pro Shop at least 30 minutes before your Tee Time, if you arrive late and the golf course do not have space to accommodate you we will not give you any refund because we will be charged by the golf course. All golf courses reserve the right to alter confirmed tee times. If the golf club cancel your reservation or change your tee time we will try to find a suitable alternative. You will be charged or refunded for any difference in the original cost. Such changes do not entitle you to cancel a holiday that is part of a package. Please also be aware that all golf courses reserve the right to make all tee times up to four balls by pairing you up with other golfers during peak times.
17. CONDITION OF GOLF COURSE
The condition of golf courses varies throughout the year. There is always on-going maintenance on tee boxes, fairways and each course has a schedule for hollow tining the greens which is an essential part of golf course preparation. Baker Travel SL. cannot be held responsible for the impact of such work but will always try and notify our clients before booking.
18. WEATHER CONDITIONS
Before you Travel
Should you choose not to travel any refund is subject to the policy of the hotel / golf course (our suppliers) in these circumstances, we will try and postpone your golf holiday; however price supplements may be incurred depending on when your holiday is re-booked. No refunds are available under any circumstance for cancellations made due to golf course closure.
During your Golf Holiday
Bad weather is unavoidable during the course of the year and as a result golf courses may either close or the golf course will operate temporary tees and greens at their discretion to protect the golf course and make sure that it is safe for golfers. Golf courses reserve the right to close or operate temporary tee boxes / greens.
All Golf Courses have their own rules about refunds for bad weather which you are bound to, in most cases unless they close the golf course you will not be entitled to a refund or have the opportunity to reschedule your round.
Each hotel and golf course sets its own “Bad Weather Policy”. All decisions regarding green fee vouchers are solely at the discretion of the hotel and golf course and are final. We cannot be held responsible should inclement weather prevail. Any vouchers issued at the Company’s discretion can be used for future bookings with Baker Travel SL.
Golf played on temporary greens and tees is non-refundable and is considered to be an accepted part of playing golf during periods of bad weather. Please note that trolley and buggy bans occur frequently when a course is wet and are determined by those in charge of the golf course. Baker Travel SL. cannot be held responsible due to inclement weather conditions.
Baker Travel SL. acts as an agent for each hotel and golf course. If you have a complaint or experience any problems during your holiday please inform the hotel or golf course immediately during your golf holiday. We recommend that you speak to the General Manager and take the matter up with him/her directly. If you do not reach an acceptable conclusion during your golf holiday please notify us in writing within 21 days of your date of return.
If you have any complaints concerning any services we provide you must inform us in writing by letter or email within 21 days of your date of return. Any assistance provided in resolving a complaint in relation to any Resort booking is provided on a goodwill basis and in our capacity as an agent.
If you have a complaint concerning any services we provide, as opposed to any service that was provided by any third party such as a hotel for whom we are not responsible, you must inform us immediately in writing within 21 days of your departure date.
We regret we cannot accept any liability if we are not notified within 21 days of your return. Our maximum liability to you if we are found to have been at fault in relation to any service we provide is limited to the commission we have earned or are due to earn in relation to the booking in question.
Please note that all extras taken by you on site such as Food, Drink, Entertainment, Spa Treatments and Transport must be paid for by you and your booking with Baker Travel SL only includes the package set out in your confirmation from us. We accept no liability for any charges you consume on site in relation to any extras outside of your package.
22. CHANGES AND CANCELLATIONS BY US
Baker Travel SL. reserves the right to make changes to and correct errors on our website and in our publications both before and after bookings have been confirmed.
23. FORCE MAJEURE
Baker Travel SL. will not be liable for additional expenses incurred through travel delay, Acts of God, force majeure or events beyond our control. Force majeure is unusual and unforeseeable circumstances beyond our control such as war or threat of war, riots, civil unrest, terrorist activity, industrial disputes, natural or nuclear disaster, fire or adverse weather conditions.
24. DATA PROTECTION
In order to process your booking and to ensure that your travel arrangements meet your requirements, we need to use the personal information you provide like as name, address, etc. We take full responsibility for ensuring that proper security measures are in place to protect your information and we will comply with the Data Protection Act 1998. In order to process your booking we must pass some of this information on to the suppliers of your travel arrangements such as hotels, golf clubs and transport companies. The information may also be provided to security or credit checking companies, credit and debit card companies, regulatory or public authorities for example customs or immigration if required by them, or as required by law. This may involve sending your personal information between different countries, including countries outside the European Economic Area (EEA) in some of these countries controls on data protection may not be as good as the legal requirements in England. This may also apply to any sensitive information that you give to us such as details of any disabilities or dietary/religious requirements. If we cannot pass your personal information on to the relevant suppliers, whether in the EEA or not, we cannot properly process your booking. By providing us with your personal information, you consent to our use of your data as detailed above.
